New Decree to implement the ECJ's National Grid decision on exit tax
On 14 December 2011, the Dutch Ministry of Finance issued an Implementation Decree (“the Decree”) on final settlement (exit) taxes, in conformity with the ECJ’s decision in National Grid Indus (C-371/10).

New Decree on Research and Development Deduction
On 21 December 2011, the Dutch Ministry of Economic Affairs published its Decree on the Research and Development Deduction (“RDD”). The RDD is a deemed tax deduction for R&D related expenses, effective as of 1 January 2012. (read more)

Headlines of new Tax Arrangement for the Kingdom announced; non-resident corporate income tax abolished?
Curacao and the Netherlands have reached an agreement in headlines on a new bilateral arrangement for the avoidance of double taxation (TAK) between both countries. This arrangement should become effective 1/1/2013 and has been based on the OECD Model Convention. (read more)

Ministry of Finance issues proposal for R&D deduction
Yesterday the Dutch Ministry of Finance disclosed the proposed new RDD: based on a decision from the Ministry of Economic Affairs (executed by Agentschap NL) taxpayers will be allowed an additional deduction of 40% of total R&D expense, wage costs excluded.

The Budget Plan contains tax measures that should become effective from 1 January 2012.
